These Terms of Use (“Terms”) govern your access to and use of the EMCertAcademy website (EMcertifyingacademy.com), applications, and services (collectively, the “Service”), operated
by EMCertAcademy LLC(“EMCertAcademy,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.

You must be at least13 years oldto use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian. The Service is intended for users in the United States.

If you choose a subscription plan, your subscription willautomatically renewat the end of each billing period unless you cancel before renewal.
You can cancel your subscription through your account settings (if available) or by contactingsupport@emca.com. Cancellation stops future renewals; it does not retroactively
refund charges already paid (except where required by law).
All sales are final and non-refundable, except where required by law or where EMCertAcademy explicitly provides a written refund policy for a particular offering.
We may change prices or plan features from time to time. If a change affects an active subscription, we will provide notice as required by law.
EMCertAcademy provides educational content only. The Service is designed for training and exam preparation and is not a substitute for professional medical judgment. You understand and agree:

The Service is not intended to collect user-submitted educational content (such as uploading files or submitting written case responses) through the core learning experience. If you contact support, you agree not to include any sensitive personal data that you do not want shared with us, and you agree not to send any real patient-identifiable information.
The Service and its content (including text, cases, explanations, videos, graphics, logos, and software) are owned by EMCertAcademy or its licensors and are protected by intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial educational use.
You may stop using the Service at any time.
We may suspend or terminate your access to the Service (in whole or in part) if we reasonably believe you violated these Terms, posed a security risk, or used the Service unlawfully.
Upon termination, your right to use the Service stops immediately. Sections that by their nature should survive will survive (including intellectual property, disclaimers, limitations of liability, and dispute provisions).
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMCERTACADEMY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED
WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMCERTACADEMY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF
PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMCERTACADEMY’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE
AMOUNT YOU PAID TO EMCERTACADEMY FOR THE SERVICE IN THE12 MONTHSBEFORE THE EVENT GIVING RISE TO THE CLAIM, OR$100, WHICHEVER IS GREATER.
(Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.)
You agree to indemnify and hold harmless EMCertAcademy and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party.
These Terms are governed by the laws of the State of Hawaii, without regard to conflict of laws rules.
Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Hawaii, and you consent to personal jurisdiction and venue there.
We may update these Terms from time to time. If we make changes, we will post the updated Terms and update the Effective date above. Your continued use of the Service after changes become effective means you accept the updated Terms.
